1. Nature of the Platform 1.1. CannacraftSA is an online directory and marketplace platform that connects users with independent cannabis/marijuana growers. 1.2. CannacraftSA does not sell, cultivate, distribute, or handle any cannabis products. We provide a platform for growers to advertise their stock and for users to view and connect with those growers. 1.3. Any transactions, communications, or agreements made between users and growers are strictly between those parties. CannacraftSA is not a party to, nor liable for, any transaction or product quality.
2. Legal Eligibility 2.1. You must be at least 18 years of age (an adult under South African law) to use this platform. By registering an account, you warrant that you are 18 years or older. 2.2. Users and growers are solely responsible for ensuring that their use of the platform and any interactions resulting from it comply with the laws of the Republic of South Africa, including but not limited to the Cannabis for Private Purposes Act and the Medicines and Related Substances Act.
3. Account Registration & Security 3.1. To access certain features, you must register an account. You agree to provide accurate, current, and complete information. 3.2. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
4. Subscriptions and Premium Features 4.1. Basic access and applications to connect with growers may be free of charge. 4.2. Access to premium features requires a paid subscription (“Subscription”). Fees, billing cycles, and features included in the Subscription will be clearly stated on our subscription page. 4.3. All subscription fees are processed via secure third-party payment gateways. You authorize us (via our payment processors) to charge your chosen payment method for recurring subscription fees until canceled.
5. Acceptable Use and Prohibitions You agree not to use the platform to: 5.1. Violate any applicable South African laws regarding the illegal sale, trafficking, or distribution of illicit substances. 5.2. Post misleading, fraudulent, or defamatory content. 5.3. Harass, abuse, or harm other users or growers. 5.4. Use automated systems (bots, scrapers) to extract data from the website without our express written consent.
6. Limitation of Liability and Disclaimer 6.1. The platform is provided on an “as-is” and “as-available” basis. CannacraftSA makes no warranties regarding the legality, safety, quality, or standard of any items advertised by growers. 6.2. To the maximum extent permitted by South African law (including the Consumer Protection Act), CannacraftSA, its directors, and employees shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the platform, interactions with growers, or consumption of any products sourced via connections made on the platform.
7. Intellectual Property All content, logos, designs, text, and software on CannacraftSA are the property of CannacraftSA or its licensors and are protected by South African and international copyright laws.
8. Governing Law These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the South African courts.
